2. Basis of contract

2.1 These Terms (together with any documents referred to in them) govern the sale of our stone worktops (“Goods”) to you, whether you are a consumer or a business.
2.2 By placing an order, you confirm that you are legally capable of entering into binding contracts and you accept these Terms.
2.3 These Terms apply to the exclusion of any other terms you may seek to impose or incorporate (unless otherwise agreed in writing by Bespoke Stone Ltd).

3. Our Goods

3.1 Our Goods are bespoke stone worktops (granite, quartz, marble) which are supplied and installed by us in Ipswich and across Suffolk.
3.2 Because they are natural materials and bespoke in nature, variations in colour, pattern, texture and size are to be expected. Any images or samples are illustrative only. You should view our showroom or request a physical sample where possible.
3.3 All dimensions provided by you must be accurate; tolerances apply and we recommend allowing for 10% waste/overage on site for cuttings, chippings or installation adjustments.
3.4 We make no guarantee that the Goods will be suitable for your particular installation; you should ensure that correct support, finishing, and installation techniques are used.

4. Ordering and acceptance

4.1 You are responsible for ensuring that the order details you submit (including dimensions, finish, colour, and installation address) are correct.
4.2 Once you place an order, we will acknowledge receipt. A contract is formed only when we send you an “Order Confirmation” email that specifically lists the Goods you have ordered and sets out the contract terms.
4.3 We may refuse or cancel any order before acceptance (for example, if stock is unavailable, the delivery address is outside our service area, or payment is declined).

5. Price and payment

5.1 The price of the Goods is as quoted on our Website at the time you place your order, unless we clearly state otherwise. We reserve the right to amend prices due to typographical error, or because of changes in material costs—but if this occurs we will notify you and you may cancel your order.
5.2 Payment must be made in full or as otherwise agreed in writing.
5.3 If you are a business customer, payment terms may differ and will be set out in writing.

6. Delivery and installation

6.1 We supply and fit the Goods in Ipswich and the wider Suffolk region. Delivery and installation times will be as quoted, but are estimates only.
6.2 You must ensure that our installers have safe, suitable access to your premises, with appropriate clearance and preparation. If access is restricted (narrow drive, low height, etc.) you must inform us in advance. Additional charges may apply.
6.3 If you are not available at the agreed time and we cannot complete installation, you may incur re-visit or re-booking charges.
6.4 Risk in the Goods passes to you on delivery and installation; title remains with us until full payment is received.

7. Returns, cancellations and refunds

7.1 Because our Goods are bespoke and manufactured to your specifications (cut to size, colour matched, etc.), we generally do not offer a right to cancel once manufacture has begun or installation has been scheduled.
7.2 If you are a consumer and your order is not bespoke (for example, a standard item) you may have the right to cancel under the Consumer Contracts Regulations 2013. However this right does not apply once the Goods have been installed or tailor-made.
7.3 If a cancellation is accepted, any refund will exclude the cost of any manufacturing begun, delivery or installation charges, and any reduction in value due to damage or wear.
7.4 Goods cannot be returned once fitted, used or damaged by you.
7.5 If you claim that the Goods are defective, you must notify us as soon as reasonably possible with photographic evidence. We may inspect the Goods and either repair, replace or refund (at our discretion) subject to our assessment.

8. Changes to these terms

8.1 We may revise these Terms at any time to reflect changes in laws, regulatory requirements, material or installation costs, or improvement of our services.
8.2 The Terms in force at the time you place your order will apply to that order unless we notify you of changes before acceptance.

9. Liability

9.1 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
9.2 Subject to clause 9.1, our liability to you is limited to the purchase price of the Goods. We are not liable for any indirect or consequential losses (such as loss of business, loss of profits, or lost wages) arising from installation, delays or defects.
9.3 You must follow all care/maintenance instructions we provide. Failure to do so may invalidate any warranty or reduce our liability.

10. Governing law and jurisdiction

10.1 These Terms are governed by English law.
10.2 Any dispute relating to these Terms or your purchase will be subject to the exclusive jurisdiction of the courts of England and Wales.
